Terms of Service

Effective Date: June 28, 2026

By creating an account or using WorkIsHard, you agree to this Agreement.

1. Eligibility

To use WorkIsHard, you must:

  • Be at least 18 years old.
  • Have the legal capacity to enter into a binding agreement.
  • Comply with all applicable laws and regulations.
  • Provide a valid email address during registration.

WorkIsHard reserves the right to suspend or terminate accounts that do not meet these requirements.

2. Account Registration

Users may create accounts using a username or nickname and an email address. WorkIsHard does not require users to provide legal names, employment history, education history, professional credentials, or government-issued identification. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

3. Pseudonymous Participation

WorkIsHard permits users to participate using usernames and nicknames. Users remain fully responsible for their content, interactions, statements, and compliance with applicable laws. Pseudonymous participation does not eliminate legal responsibility for user conduct.

4. Acceptable Use

You agree not to:

  • Violate any law or regulation.
  • Harass, threaten, abuse, stalk, or intimidate others.
  • Engage in fraud or deceptive conduct.
  • Impersonate another person, public figure, business, or organization.
  • Falsely claim affiliation with an employer, government agency, or institution.
  • Upload malware, viruses, or harmful code.
  • Attempt unauthorized access to systems or accounts.
  • Scrape or harvest user information.
  • Circumvent platform restrictions or moderation actions.
  • Operate unauthorized automated bots.

WorkIsHard may remove content or restrict accounts that violate these rules.

5. Professional Humor, Satire, and Opinions

WorkIsHard encourages professional discussion and workplace-related humor. Users understand that content may include opinions, commentary, humor, satire, parody, and personal experiences. User content represents the views of individual users and does not necessarily reflect the views of WorkIsHard. WorkIsHard does not endorse user-generated content.

6. No Professional Advice

Content on WorkIsHard is provided for informational and entertainment purposes only. Nothing on the platform constitutes legal, financial, tax, medical, employment, or professional consulting advice. Users should seek qualified professional guidance before making important decisions.

7. No Guarantee of Results

WorkIsHard does not guarantee employment opportunities, recruiting outcomes, business relationships, career advancement, networking success, professional opportunities, or financial results. Users assume all responsibility for decisions made based on information obtained through the platform.

8. User Content Policy

Ownership. Users retain ownership of content they submit to WorkIsHard, including posts, comments, images, videos, profile information, and messages submitted through platform features.

License Granted to WorkIsHard. By posting content, you grant WorkIsHard a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, distribute, and process your content solely for operating, maintaining, improving, and promoting the platform.

Prohibited Content. Users may not post content that is unlawful, defamatory, fraudulent, promotes violence, contains credible threats, constitutes harassment, contains hate speech, promotes terrorism, infringes copyrights or trademarks, violates privacy rights, reveals another person's private information without authorization, contains malware, or is spam or unsolicited advertising. WorkIsHard may remove content at its sole discretion.

9. Content Moderation

WorkIsHard may, but is not obligated to, review content, remove content, restrict content visibility, suspend accounts, or terminate accounts. WorkIsHard is not responsible for monitoring every item of content submitted by users.

10. Reporting Content

Users may report content that they believe violates this Agreement, including harassment, threats, hate speech, spam, impersonation, fraud, copyright violations, and illegal content. Submitting a report does not guarantee content removal. WorkIsHard reserves sole discretion in determining whether content violates platform rules. False, abusive, or malicious reports may result in account restrictions.

11. Copyright Policy and DMCA

WorkIsHard respects intellectual property rights. Copyright owners who believe content infringes their rights may submit a notice to legal@workishard.co containing contact information, identification of the copyrighted work, identification of the allegedly infringing content, a good-faith statement, a statement under penalty of perjury, and a physical or electronic signature. WorkIsHard may remove allegedly infringing content while investigating claims. Repeat copyright offenders may have their accounts terminated.

12. Privacy Policy

Information We Collect. WorkIsHard may collect username or nickname, email address, and content voluntarily submitted by users. We may also automatically collect IP address, browser information, device information, session information, usage information, security logs, and diagnostic logs. We may use cookies and similar technologies to maintain login sessions, improve platform performance, protect platform security, and remember preferences.

How We Use Information. Information may be used to operate WorkIsHard, maintain platform security, prevent abuse and fraud, improve services, respond to support requests, and comply with legal obligations.

Information Sharing. WorkIsHard does not sell, rent, or trade user information. Information may be shared with service providers assisting platform operations, to comply with legal obligations, or to protect the platform and its users. We use reasonable safeguards to protect your information but cannot guarantee absolute security.

13. Third-Party Links and Services

WorkIsHard is not responsible for third-party content, privacy practices, security practices, or products or services. Use of third-party services is at your own risk.

14. DISCLAIMER OF WARRANTIES

WORKISHARD IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKISHARD DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY. WORKISHARD DOES NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE OPERATION.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKISHARD, ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR LOST BUSINESS OPPORTUNITIES ARISING FROM OR RELATED TO USE OF THE PLATFORM. YOUR USE OF WORKISHARD IS AT YOUR OWN RISK.

16. Indemnification

You agree to defend, indemnify, and hold harmless WorkIsHard and its owners, employees, affiliates, contractors, and representatives from claims, liabilities, losses, damages, costs, and expenses arising from your use of the platform, your content, your conduct, your violation of this Agreement, or your violation of applicable laws or third-party rights.

17. Account Deletion

Users may request deletion of their accounts through platform settings or by contacting WorkIsHard. Upon deletion, public profile information may be removed and access to the account may be disabled. Certain records may be retained for legal, security, fraud-prevention, moderation, backup, or compliance purposes. WorkIsHard reserves the right to retain information as required by law or reasonably necessary to protect the platform and its users.

18. Account Suspension and Termination

WorkIsHard may suspend, restrict, or terminate accounts for violations of this Agreement, security concerns, illegal activity, abuse of the platform, or harmful conduct toward users or the platform. Termination may occur with or without prior notice.

19. Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. Except where prohibited by law, any dispute, claim, or controversy arising from or relating to WorkIsHard or this Agreement shall be resolved exclusively through final and binding arbitration rather than court proceedings. Arbitration shall be conducted by a recognized arbitration provider selected by WorkIsHard, conducted in English, governed by applicable federal and California law, and take place in California unless otherwise required by law. The arbitrator shall have exclusive authority to determine issues relating to the interpretation, applicability, enforceability, or formation of this arbitration provision. Nothing in this section prevents either party from seeking temporary injunctive relief regarding intellectual property rights or other matters requiring immediate court intervention.

20. Class Action Waiver

To the fullest extent permitted by law, claims against WorkIsHard may only be brought on an individual basis. Users waive any right to participate in class actions, collective actions, representative actions, mass actions, or similar proceedings. Claims may not be consolidated with claims brought by other users. If this waiver is found unenforceable, any class-related claims must be litigated exclusively in a court of competent jurisdiction in California.

21. Changes to This Agreement

WorkIsHard may update this Agreement from time to time. Changes become effective upon posting. Continued use of WorkIsHard after changes are posted constitutes acceptance of the revised Agreement.

22. Governing Law

This Agreement shall be governed by the laws of the State of California, excluding conflict-of-law principles. Except where arbitration applies, legal proceedings shall be brought exclusively in California.

BY CREATING AN ACCOUNT OR USING WORKISHARD, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THIS AGREEMENT, INCLUDING THE BINDING ARBITRATION AND CLASS ACTION WAIVER PROVISIONS.
